2. Services Provided

HighReach provides AI-powered tools for ad creative generation and marketing automation, including but not limited to:

• AI Avatar Videos - Talking-head spokesperson videos with AI avatars
• UGC Video Ads - User-generated content style video ads
• Product Photoshoots - AI-generated professional product photography
• Product Videos - Image-to-video transformations for products
• Image Ads - AI-generated image advertisements
• Brand asset management and creative workflows

2.2. Service Availability

All features are subject to change, enhancement, or discontinuation at our sole discretion without notice.

3. User Responsibilities

3.1. Lawful Use

You agree to use HighReach only for lawful purposes and in compliance with all applicable laws and regulations.

3.2. Prohibited Content

You agree NOT to use HighReach to create, upload, or generate content that:

• Contains nudity, sexually explicit material, or pornographic content
• Infringes on copyright, trademark, or other intellectual property rights of third parties
• Promotes violence, hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Contains illegal content or promotes illegal activities
• Includes malware, viruses, or malicious code
• Contains false, misleading, or deceptive claims about products or services
• Violates the privacy rights of individuals or includes personal information without consent
• Promotes dangerous or harmful activities that could cause physical harm
• Impersonates other individuals, brands, or entities without authorization
• Contains spam, phishing attempts, or fraudulent schemes

Warning: HighReach reserves the right to immediately suspend or terminate accounts that violate these content policies. We may also report illegal content to relevant authorities.

3.3. Proper Conduct

You agree not to:

• Reverse engineer or tamper with any part of the platform
• Reproduce, resell, or commercially exploit the services without permission
• Use automated systems or bots to abuse the service or circumvent usage limits
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the platform's infrastructure or security measures

3.4. User Responsibility for AI-Generated Content

You are solely responsible for all content generated using HighReach's AI tools, including but not limited to images, videos, and text. You acknowledge that:

• You must review all AI-generated content before publishing or distributing it
• You are responsible for ensuring content complies with applicable laws, regulations, and advertising standards
• You are responsible for obtaining necessary permissions, licenses, or rights for any source materials you upload
• You bear all liability for how you use, publish, or distribute AI-generated content
• You must ensure content is factually accurate and not misleading when used in advertising

4. Privacy and Data Use

We may analyze user data to improve our platform, AI models, and overall user experience.

5. Intellectual Property

All content, visuals, tools, and AI technologies provided by HighReach are the intellectual property of HighReach AI.

5.2. AI-Generated Content Ownership

Content generated by HighReach's AI tools based on your inputs, prompts, and uploaded materials is owned by you, subject to the following conditions:

• You retain ownership and all rights to content you create using our AI tools
• You grant HighReach a limited license to use anonymized and aggregated data from generated content to improve our AI models and services
• You represent and warrant that you have all necessary rights to any materials you upload to generate content
• HighReach makes no claim to ownership of your generated content, but reserves the right to remove content that violates these Terms

5.3. Platform Restrictions

You may not copy, modify, distribute, or exploit any part of the HighReach platform, software, or AI technologies without express written consent.

6. Limitation of Liability

HighReach is provided "as is" without warranties of any kind — express or implied.

We are not liable for any direct, indirect, incidental, or consequential damages from your use of the platform.

6.3. AI-Generated Content Disclaimer

IMPORTANT: HighReach provides AI tools to generate creative content, but we are NOT responsible or liable for:

• The accuracy, quality, appropriateness, or suitability of AI-generated content for any purpose
• Any errors, inaccuracies, omissions, or misleading information in generated content
• Copyright infringement, trademark violations, or other intellectual property issues arising from generated content
• Any legal claims, damages, losses, or liabilities resulting from your use, publication, or distribution of AI-generated content
• Content that inadvertently violates advertising standards, regulations, or platform policies
• Business losses, lost revenue, reputational damage, or other consequential damages from AI-generated content
• Third-party claims arising from your use of AI avatars, voices, or other AI-generated elements

You acknowledge that AI technology has limitations and may produce unexpected, biased, or inappropriate outputs. It is your sole responsibility to review, verify, edit, and approve all AI-generated content before using it in any advertising, marketing, or commercial context.

6.4. Indemnification

You agree to indemnify, defend, and hold harmless HighReach AI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of AI-generated content
• Your violation of these Terms or applicable laws
• Your infringement of any third-party intellectual property rights
• Any content you upload or provide to the platform
• Your breach of any representations or warranties made in these Terms

7. Termination

7.1. Right to Terminate

We may suspend or terminate your access at any time if you breach these Terms.

7.2. Post-Termination

After termination, your right to use the platform will cease immediately.

8. Content Moderation and Enforcement

8.1. Monitoring Rights

HighReach reserves the right (but not the obligation) to monitor, review, or scan user-generated content and AI outputs to ensure compliance with these Terms and applicable laws. We may use automated systems and human review to detect prohibited content.

8.2. Enforcement Actions

If you violate these Terms, we may take enforcement actions including:

• Issuing warnings or requiring content removal
• Temporarily suspending your account or specific features
• Permanently terminating your account without refund
• Reporting illegal content to law enforcement or relevant authorities
• Pursuing legal action for damages or injunctive relief

8.3. No Liability for Removal

HighReach is not liable for any loss of content, data, or access resulting from enforcement actions taken for violations of these Terms. You are responsible for maintaining backups of your content.

9. Changes to Terms

We may revise these Terms periodically. Updates will be posted with a new effective date.

9.2. Continued Use

By continuing to use HighReach after changes are posted, you accept the revised Terms.

10. Governing Law

These Terms shall be governed by the laws of United States of America and Canada, and any disputes shall be resolved in the courts of Jurisdiction.
